Guarantee

By sending payment and accepting the delivery of this puppy from D & S Kennel, buyer hereby accepts the terms and conditions of this Contract/Warranty.

D & S Kennel makes every effort to provide you with a healthy, happy puppy. The night before the flight your pup will be seen by our shippers vet and issued a health certificate in order to fly out. We require that we be called upon picking up your pup at the airport and that you email us 3 days after you receive your pup with an update of how he or she is adapting to it's new surroundings and family.   This will validate your 1 year congenital defect guarantee. No guarantee or compensation will be considered without adherence to these two requests. Also, help us help you keep your pup in good condition by calling us immediately if you feel that your pup is not doing well or if you have any concerns about your pup.  

We guarantee your puppy against any life threatening congenital defect for a period of 12 months from puppy's date of birth. If within 1 year your puppy is found to have a life threatening congenital defect the buyer may return the puppy to us along with registration papers and veterinarian report stating problem found. Seller reserves the right for a second opinion in this matter. Under no circumstances should the puppy be euthanized without first contacting us. To do so will nullify guarantee. Should death occur within this period a necropsy must be performed by a hystopathology lab  to determine if death was caused by a congenital defect. If death was caused by a congenital defect, the necropsy report would need to be provided to us for replacement of puppy with next available puppy of same value. If a replacement puppy is not available within 3 months full purchase price will be refunded. The buyer is responsible for any return shipping fees or shipping fees for replacement puppy. Seller is not responsible for any vet bills incurred. No guarantee is made as to size, color, or breeding capability. Preventable or curable health problems are not covered under guarantee. Hypoglycemia is not covered as it is preventable. No warranties or guarantees expressed or implied are made under this contract except as listed above.

In the event of any litigation in connection with this contract, both the Seller and the Buyer shall each be responsible for their own attorney's fees and costs. The venue and jurisdiction for litigation arising out of or related to this contract shall lie exclusively in Mccurtain County Oklahoma. In the event the Buyer prevails in litigation, the total awarded value shall not exceed the value of the original purchase price.

This Contract/Guarantee is between Seller and Buyer and can not be assigned without the express written consent of Seller.
